What is a Visa Refusal?


A visa refusal decision is made by the Department of Home Affairs. This happens after a visa has been applied for and has been assessed based on the information provided to the Department. Refusals most commonly occur for business, student, work and skilled visas, but any visa application may be refused. If a visa is refused, the applicant may not be able to enter Australia or, if already in Australia, may be required to leave.

Australian visas can be refused for reasons such as false, misleading or inadequate information, not meeting Australia’s health or character requirements or failing to meet the conditions of a previous visa. In most cases, however, it is due to simple mistakes. Visa applications are complicated and lengthy. Applying incorrectly or for the wrong type of visa is often the reason for the refusal. Under s48 of the Migration Act, if a visa is refused or cancelled while the applicant is in Australia, then the applicant will need to depart Australia before any possibility of reapplying (except in a minimal number of exceptional cases).
